Who these terms are between

These terms are between you, the business owner, and me, Ryan Craig. I run Open Lot Digital. They cover the websites I build and the monthly plans that keep them running. When you say yes to a build or pay for a plan, you agree to them.

If anything here is unclear, ask me before you say yes.

Founding clients (my first three)

  • Founding spots go to the first three businesses that say yes and go live. A free build that ends in no doesn’t use a spot. Before I start your build, I’ll tell you in writing whether you’re in a founding spot. If all three fill while I’m building yours, I’ll tell you before you decide, and you can still say no and owe nothing.
  • $0 to build. Nothing is owed until you’ve seen your finished site and said yes.
  • If you say no, you owe nothing and the site doesn’t launch.
  • After launch, the monthly plan is $49 a month, everything included (hosting, your domain and updates). Your first $49 is due the day your site goes live, then once a month.
  • Your $49 price is locked for 12 months from launch.
  • There’s a 6-month minimum, starting at launch. If you give notice during it, your plan ends at the end of month 6 or when your 30 days’ notice runs out, whichever is later.
  • After the 6 months, it’s month to month. Cancel any time with 30 days’ notice.
  • After your 12 months, I’ll give you at least 30 days’ notice by email before any price change, and you can cancel instead.
  • In return, I ask for an honest testimonial in your own words and your OK to show your site as an example of my work. I’ll never make a Google, Yelp or Facebook review part of the deal.
  • When I show your testimonial, it carries this label: “Founding client: got a free build and a lower monthly rate. I asked for an honest testimonial in return.” The label goes right next to your words wherever I use them: this site, my Google profile, social posts or anything printed. If you change your mind about what you said, tell me and I’ll take it down. If you’re a relative or friend of mine, the label says so.

Local and Contractors plans (after my first three)

  • Local: $499 to build, then $79 a month. Contractors: $999 to build, then $129 a month.
  • Half the build price is due to start. The other half is due when you’ve approved the finished site and it goes live.
  • The monthly plan starts the day your site goes live. It’s month to month. Cancel any time with 30 days’ notice.
  • If I ever change your monthly price, I’ll give you at least 30 days’ notice by email first, and you can cancel instead.
  • Refunds: change your mind before I start building, and I refund the first half in full. Once I’ve started building, I refund the first half minus anything I’ve already paid out for your site, like your domain registration.

What the monthly plan covers

  • Hosting and the security padlock (https), handled
  • Your domain registered in your name, with renewals included
  • One update every week, like your specials (send it to me by Thursday noon)
  • Your hours and holiday hours kept matching your Google listing
  • Up to 30 minutes of other changes each month
  • If you ever leave, your site files and your domain go with you
  • Contractors plan: also includes 2 Google posts a month and 1 new town page every quarter.
  • Google add-on, $29 a month, for founding and Local plans only, month to month with 30 days’ notice: 2 Google posts a month plus drafted replies to your reviews for you to approve.
  • Not included: new pages ($75 each), redesigns, logos and graphics, photography, setting up a new ordering or booking system, ads and social media. I’ll always tell you the price before I do any extra work.

Paying

  • Payments run through Stripe. I send invoices by email. You can pay by bank transfer (ACH) or card. I prefer bank transfer.
  • Monthly plans are billed once a month, starting the day your site goes live.
  • Monthly plans charge the card or bank account you pay with automatically each month until your plan ends.
  • If a payment fails, I’ll call or text you first. If a bill is more than 30 days late, I may pause updates until it’s caught up.

You own your domain, your listing and your content

  • Your domain (your web address) is registered in your name.
  • Your Google listing stays in your name. You add me as a Manager, so I never need your password.
  • Your menu, photos, logo and words stay yours.
  • If you leave, your site files and your domain go with you. Nothing is held back. After that, renewing the domain is up to you.

What I need from you

  • The menu, hours, photos and details for your site, and a look to confirm they’re right before launch.
  • Only photos, logos and words you own or have permission to use.

Accessibility

I build to the WCAG 2.1 AA accessibility guidelines as a target. That’s a goal I work toward on every page, not a legal promise that a site meets every accessibility law.

Other companies

Your site relies on services I don’t run, like Cloudflare (hosting), your domain company, Stripe (payments) and Google. If one of them has an outage or changes its rules, I’ll work to sort it out, but I’m not responsible for their downtime.

Ending a plan

  • Founding clients: after the 6-month minimum, cancel any time with 30 days’ notice.
  • Founding clients: if you give notice during the 6-month minimum, your plan ends at the end of month 6 or when your 30 days’ notice runs out, whichever is later.
  • Local and Contractors: cancel any time with 30 days’ notice.
  • Your plan ends on the last day of the billing month in which your 30 days’ notice runs out. That month’s payment is your last one.
  • Tell me by phone, text or email. I’ll confirm your last billing date in writing.
  • I can end a plan with 30 days’ notice too. Either way, your files and your domain go with you.

Limits on what I’m responsible for

If something goes wrong, the most I’m responsible for is what you paid me in the 12 months before the problem. I’m not responsible for lost profits or other indirect losses. Some places don’t allow limits like these, so they apply only as far as the law allows.

Wisconsin law

These terms are governed by the laws of the State of Wisconsin.

Changes to these terms

If I change these terms, I’ll update this page and the date at the top. If a change affects current clients, I’ll email you at least 30 days’ notice first.
